In the past five decades, EIC has provided feedback to FIDIC or, the International Federation of Consulting Engineers, on the development of its standard forms of contracts for construction works. FIDIC and EIC share the conviction that standardisation, both in technical and administrative matters, is more likely to result in the satisfactory and trouble-free execution of international construction projects. In the wake of the FIDIC 1999 suite of standard contract forms for major works, EIC published four commentaries to the FIDIC 1999 edition, namely the:
- EIC Contractor's Guide to the FIDIC Conditions of Contract for EPC Turnkey Contracts (hereafter referred to as the FIDIC 1999 ‘Silver Book’), published in March 2000, with subsequent revision published in August 2003;
- EIC Contractor's Guide to the FIDIC Conditions of Contract for Construction (hereafter referred to as the FIDIC 1999 ‘Red Book’), published in March 2002, reprinted in March 2003;
- EIC Contractor's Guide to the FIDIC Conditions of Contract for Plant and Design-Build (hereafter referred to as the FIDIC 1999 ‘Yellow Book’), published in March 2003;
- EIC Contractor’s Guide to the FIDIC Conditions of Contract for Design, Build and Operate (hereafter referred to as the FIDIC ‘Gold Book’), published in September 2009.
When the Multilateral Development Banks (MDBs), under the leadership of the World Bank, collaborated to produce an MDB Harmonised Edition of the 1999 ‘Red Book’, the so-called ‘Pink Book’, in which the General Contract Conditions contained the standard wording which previously had been incorporated by the MDBs in the Particular Conditions, EIC followed suit and published a fifth commentary, namely the:
- EIC Contractor’s Guide to the FIDIC 2010 MDB Harmonised Construction Contract (hereafter referred to as the FIDIC ‘Pink Book’), published in April 2011.
In preparing this first EIC Guide on the FIDIC 2017 Conditions of Contract for Plant and Design Build, hereafter referred to as the ‘FIDIC 2017 Yellow Book’, we have followed a similar approach to the EIC Guides to the FIDIC 1999 edition and comment only where we believe that there are matters of importance to consider and only at length where there are important issues at stake.
